I do not think that DoS or USCIS will agree to this. The last time they messed up, there was a huge fallout. This time around, they know the pending numbers and will be very cautious by moving the dates. They cannot move the dates for EB2 alone. They will have to do so for EB3 too. And when that happens, July 2007 repeats itself.
To get a grip on the number of applications that are eligible to file for 485, USCIS was planning on implementing a process where you have to register to indicate you want to file a 485. They are going to use those numbers to move the dates. Dont know what happened to that move.
So, rather than waste your efforts in trying to get USCIS/DoS to budge, work towards a comprehensive solution by lobbying for a change in law.
The change is only administrative. So the visa dates do not move. USCIS will allow all to file for I485 when PD is not current.. That is what we are fighting for.
A comprehensive solution is what everybody wants. But that is not possible untill after the mid-term elections in Nov.

Here you go. PERM Regulations as published in Federal register (http://www.foreignlaborcert.doleta.gov/pdf/PERM_Final_Rule_12-27-04_FR.pdf). Search for "revoke".
Well, here is a correction. There is no time limit for revocation. The CO can revoke PERM labor cert any time. This is not same as revocation by employer. If a PERM LC comes up for audit and CO finds some thing wrong with it, CO can revoke it.

santb1975, if my memory serves me right, unitednation was self employed for a period before he got his GC. I read it on the net, and as most things don't remember the link. The gist of it was: in the interview unitednation was asked about it, and he defended it successfully. But I think he was employed at the time of the GC.

I just thought, if we all dress up formally and carry an item which reflects who we are and why we are in US. It should reflect the high skilled people we represent:
1. Computer Engineers can carry laptops
2. Doctors can dress in there uniform.
3. Nurses can do the same.
etc etc.
It'd good for the cameras, press and average citizens looking at us.
I was wondering what those cooks and waiters in Desi Restaurants will wear, what would my grocer would wear? Dhoti and Baniyan? IF they care to join US?

Fragomen is a big firm and the fact they are sitting quite shows that there was some wrongdoing on their part. Let's hope they come out with a statement. I am not sure why they are so quite.

There are two possibilities, either Fragoman itself has pushed the statement through these groups or groups have themselves put out those statements. In either case, it is very hard to believe if they know that Fragoman is in fault, they will give such statements in favor of it. It is not likely that they don't know what is going on.

Yes, I agree. While coming back to home I just discussed on that line with my wife. We remembered our last visit in Income Tax department (For last income tax return - prior to come to USA)back in India and compared it with today's FP related visit and we concluded after 9 years we are at the same level with only difference back there we also had to pay (Under table) for getting our legitimate tax return. I hope we do not have to go through 2nd FP visit.

yes, you are right, that we can work as long as I 797 is approved, but, until I join the new job, I will be out of status.. and I can't join the new job, until i get my medical license,, and it takes 1-2 months, after june 30th. so, for those 1-2 months, i can't work, and if i am not working even though i have valid I 797, i am out of stutus.. right?

With in a 7 days of H1B crisis, there was a bill introduced in senate. I assume high-tech industry may be strongly backing this bill to address the H1B block-out. There may be a chance that this bill may pass without part of CIR due to the strong pressure by hitech-industry. The intension of who ever sponsered this bill and whoever supporting the bill sponsers is to have a bill independent of CIR to address the H1B crisis immediatly. Otherwise, why one should introduce such bill if already SKIL and STRIVE bills are pending in senate and house?

" - can experience gained as a software engineer (at the same company) be used towards an EB2 application filed as a software architect? Does a software architect qualify as a "different position"?

I have been in Australia for the last two years on account of a job-related posting of my wife down here and we applied for Aus perm residency as a back-up to the US GC (though fortunately we got our GC during the last months of FY2007-08, through CP). Here are my 2 cents related to Aus immigration and the country in general.
The application process is relatively straightforward and can be self-sponsored, especially if you have the requisite points which is easy if (a) you have the 'in-demand' skill sets (which can be found at the immigration website ), (b) are younger than 35 and (c) score high on the English language test (ELTS). Note that both you and your spouse will have to sit for IELTS.
The one bothersome aspect is that unless you have undergrad degree from US/UK/certain other European countries, you need to undergo skill assessment, where you have to write a long essay about your skills and qualification and have it endorsed by the relevant licensing authority in Australia. It is not a biggie, but just a pain to write all that stuff.
Immigration process is easier if you have a job offer and the company sponsors you - I have known instances where such cases were approved in 1-2 weeks (one friend was going to work on something related to Australian defence and he was approved in 2 days!!), or if you are a physician/certain other skills working in non-metro areas. In some states, especially Victoria, the state can also sponsor you, but I dont think it makes the process much faster and there are requirements to stay in the state for 2 years.
Regarding our own experience, we applied with my wife (an Engineer) as the principal applicant last year around April/May. We had enough points and everything and we used an immigration agent - however, we are yet to hear anything positive. This January we got an e-mail saying that her profession had been put on a fast-track for approval, but still no news and it is getting close to an year.
My own idea is that given the recession, Aus immigration is in no hurry to approve cases now. In fact, they have recently cut back on the number of skilled-immigration approvals. A year ago, everything was fine, and due to the mining boom here, demand outstripped supply for all kinds of engineers, both IT and non-IT. With the world economy down, jobs being lost here - the situation has changed. The Australians are much more protectionist than Americans, and are very wary of foreigners taking their jobs in this economy. I work in the academia where it is different, and my wife works in non-IT (Mech Engineering) sector, so I am not totally sure how the situation is in IT, finance, marketing etc.
To summarize: compared to the US GC, the application process is easier, wait is theoretically shorter, but be a little careful in this recession economy and make sure there are jobs here before taking the plunge.
Btw, our cost was about Aus$5000-6000, including the immigration agent fee. Plus it was about Aus$700 for the IELTS tests for both of us.
Although you did not specifically ask, regarding life-style in Australia: the people here are usually very laid-back (work week consists of 37 hrs, with defined tea breaks!), love to be out in the beach or bars after work and drink beer/wine (yes, the stereotype is somewhat true), but they are usually efficient in what they do. The pace of life is certainly different from the US. However, cost-of-living is slightly higher, especially since you are pretty much forced to live in the major cities, where real estate is quite expensive. It was through the roof last year, but it is starting to fall a bit. Grocery items are usually almost double the price, gas ('petrol') is significantly more expensive, and car prices are laughably high ( you will find most people driving smaller, fuel-efficient cars). I would say that cost-of-living is slightly higher than major US cities like Boston, SF, NYC etc.
Overall, we have enjoyed our stay in Australia, but will be going back to the US (yes, even in this economy) because I still feel that even now, the best future prospects are still in the US (or perhaps, India). The mining boom, fulled by development in India and China, has been a major pusher of Aus economy, but IMHO, they do not have much to fall back on e.g Biotech/IT - Singapore, China and India will probably beat them in those industries. But that is just my own opinion. YMMV.

I have not applied for H4 with premium processing. I applied it the normal way and have not got the approval notice yet.
Now am wondering if
1. Is it necessary that one's spouse should apply concurrently?
2. Can one's spouse (H4) apply for 485 as a follow up to her husband's application in July even if the visa numbers are not available (i.e in August when the visa bulletin says Unavailable)?
Would that be possible?

He has to realize that this immigration issue cannot be just explained by two bottles of gum balls. Putting a few graphs and a gum ball jar will not hide the deep emotional turmoil that is behind this presentation. There is no rational behind this idiotic talk. World pupulation shifts cannot be viewed separately from economic situations. With farming and other infrastructural industry heavily depending on cheap labor to survive, did he show a plan that will help the american industry to survive for 1 single year if the immigration is reduced to 1965 level. Infact if it is done for 2 years then there wont be any need to do it again because american economy will collapse by then. Also other world economies will also collapse because everybody depends a lot on this economy to buy their products. Here is the only place where money can be simply printed (without any actual value).
